A CHARTER ORDINANCE AMENDING CHARTER ORDIANANCE NO. 11 AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT AUTHORIZED AND LIMITING THE TAX LEVY FOR THE LIBRARY FUND IN ANY ONE YEAR ON EACH DOLLAR OF ASESSED TANGIBLE VALUATION.

Section 1. Whereas, the City of Downs, a city of the third class, by the power vested in it by Article 12, Section 5, of the Kansas constitution did adopt Charter Ordinance No. 11 limiting the tax levy for the library fund on and after February 15, 1988, to a maximum rate of 3.5 mill.

Section 2. Therefore, the governing body of the City of Downs does wish to amend Charter Ordinance 11 to read as follows:

Section 2. The governing body of the City of Downs is hereby authorized and empowered to levy taxes in each year for the following city purposes, but said governing body shall not fix a rate of levy in any one year on each dollar of the assessed annual valuation of the city in excess of the following rate:

Library Rate - 5.5 mill.

Section 3. Any changes to the maximum tax levy for the library fund of the City of Downs, Kansas, shall henceforth be established by the governing body of the City of Downs, Kansas, by regular ordinance.

Section 4. This ordinance shall be published once each week for two consecutive weeks in the official city newspaper.

Section 3. All other provisions of Charter Ordinance No. 11 are hereby affirmed.
