Article 3. Zoning Regulations

16-301. Zoning ordinance incorporated.

There is hereby incorporated by reference for the purpose of regulating and restricting the use of land and the use and location of buildings and structures within the corporate limits of the city that certain standard ordinance known as the zoning ordinance for the City of Downs, Kansas, Edition of 2004, prepared and published in book form by Riggs Associates of Lindsborg, Kansas. Not less than three copies of the Standard Ordinance for the City of Downs, Kansas, shall be marked or stamped “Official Copy as Incorporated by the Code of the City of Downs, Kansas” with all sections or portions thereof intended to be omitted or changed clearly marked to show any such omission or change and to which shall be attached a copy of this article or the adopting ordinance, and filed with the city clerk to be open to inspection and available to the public at all reasonable hours. The municipal judge and all administrative departments of the city charged with enforcement of the zoning ordinance shall be supplied, at cost to the city, such number of official copies of such zoning ordinance for the city similarly marked, as may be deemed expedient.

16-302. Zoning map.

(a) The location boundaries of the zones and districts created by the zoning ordinance for the City of Downs, Kansas, Edition of 2004, hereinabove incorporated by reference, are hereby established as defined and shown on the map entitled “Zoning Districts Map, Downs, Kansas” dated July 19, 2004, prepared by Riggs Associates of Lindsborg, Kansas, and signed by the mayor and city clerk and hereinafter referred to as the “zoning map.”

(b) The zoning map above referred to and all notations thereon are hereby incorporated by reference and made a part of the zoning ordinance incorporated by reference in section 16-301 of this article.

(c) The zoning map shall be marked “Official Copy as Incorporated by the Code of the City of Downs, Kansas” and filed in the office of the city clerk to be open to inspection and available to the public at all reasonable hours.
